Mika Vauhkala shared the application to the European Court of Human Rights that honorable lawyer Virginie de Araújo-Recchia prepared.
Update : The ECHR has sent a letter confirming that the application is admissible, which marks the completion of the first milestone.
This application concerns all European citizens well beyond the personal case of Mika.
Indeed, the proceeding merits question the :
- discrimination based on presumed state of health,
- objective and supposed reasonable justification to infringe the most fundamental rights in regard of social, cultural and private life,
- moral prohibition of any genetic manipulation,
- obligation to undergo an innovative, untested gene therapy, with a huge lack of scientific justification such as the use of RT-PCR tests (Astrid Stückelberger) and evidences since autumn 2021 that vaccines did not prevent transmission (Dr Asko Järvinen)
- disregard of higher risk of serious adverse events and other method known and improved, the arbitrarily interfering in the private sphere of individuals,
- respect of freedom of conscious and religion,
- intense pressure exerted by the Covid passport.
They also highlight the unconstitutionality of law, cumulative irregularities in the domestic proceedings, such as dismissed appeal with no justifications, disregard evidences about conflict of interest, persistent omission that raises legitimate doubts as to the judge’s impartiality, dismissed request for a police investigation, refusal to hear key witnesses, enforcement proceeding for the payment of exaggerated costs and interest. In short, lack of respect of the objective impartiality of the courts, procedural fairness and effective access to justice.
Finnish legislation and constitution has been violated but also international laws, European case law from ECHR and European Court, and conventions regarding the medical ethics such as the Universal Declaration on Bioethics and Human Rights, The Oviedo Convention, The Nuremberg Code and the Declaration of Helsinki and the European Convention on Human Rights.
For those reasons, the Mika case is historical and crucial as said honorable attorney Virginie de Araújo-Recchia :
« This digital ID system could enable widespread verification and access controls
for services, public spaces, and even daily life. […] If unchecked, the EUDI Wallet
could amplify these dangers across Europe, turning temporary
pandemic measures into permanent digital control tools.
We must act now to protect fundamental rights before it’s too late.»
